The National Center for Lesbian Rights (NCLR) filed a reply brief within the California Supreme Court in which it argued that the Court must ensure that children born to same-sex couples have the same right to financial support from both parents as all other children. NCLR filed on behalf of Emily B., who is seeking child support from her ex-partner, Elisa B.
The couple had twin children that they raised before their separation. One of the children was born with Downs Syndrome and requires around-the-clock care.
The case is one of three involving children born to lesbian parents that are currently before the California Supreme Court. All three ask if both partners in a same-sex couple who use artificial insemination to have children together are legal parents.
